This website is operated by BOSA ("we," "us," or "our"). We offer this website, including all information, tools, and services available from it to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), including any additional terms and policies referenced herein or available by hyperlink. These Terms apply to all users of the site, including browsers, customers, and contributors of content.

Please read these Terms carefully before accessing or using our website. If you do not agree to all of these Terms, you may not access the website or use any of our services.

2. Online Store Terms

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). A breach or violation of any of these Terms will result in immediate termination of your Services.

3. Our Products Are Made to Order

All BOSA products are produced on demand by our print-on-demand fulfillment partner after you place your order. We do not hold finished inventory. This has several important consequences you should understand before ordering:

• Orders enter production shortly after they are placed and cannot be modified or cancelled once production has begun.
• Because items are manufactured specifically for you, we do not accept returns for change of mind, or exchanges for a different size or color. See our Shipping & Return Policy for full details.
• Minor variations in print placement, color, and garment sizing are inherent to the printing process and are not considered defects.

4. Accuracy of Product Information

We make every effort to display the colors and images of our products as accurately as possible. We cannot guarantee that your device's display of any color will be accurate. Product images may include mockups or lifestyle photography, and the item you receive may differ slightly in appearance.

Sizing charts are provided as a guide. Garment measurements may vary within manufacturer tolerances. We are not responsible for a fit that does not meet your expectations where the item conforms to the published size chart within normal tolerances.

5. Pricing, Availability, and Modifications to the Service

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service, or any product, without notice.

We reserve the right to refuse or limit any order. We may limit or cancel quantities purchased per person, per household, or per order. If we make a change to or cancel an order, we may attempt to notify you at the email address provided at the time of purchase.

6. Errors, Inaccuracies, and Omissions

Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Service is inaccurate at any time without prior notice, including after you have submitted your order.

7. Order Acceptance and Payment

Your receipt of an order confirmation email does not constitute our acceptance of your order. We reserve the right to accept or decline your order for any reason, including suspected fraud or an unauthorized or illegal transaction.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store, and to promptly update your account and other information, including your email address and payment details, so that we can complete your transactions and contact you as needed.

Payments are processed by third-party payment processors. We do not store your full payment card details.

8. Shipping, Delivery, and Risk of Loss

Delivery estimates shown on our site or at checkout are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs authorities, weather, or other circumstances beyond our reasonable control, and we do not provide refunds, discounts, or other compensation for delayed delivery.

You are responsible for providing a complete and accurate shipping address. Costs and losses arising from an incorrect or incomplete address, from an unclaimed package, or from a package refused or abandoned at customs are your responsibility and are not refundable.

International orders may be subject to import duties, taxes, and customs fees imposed by the destination country. These are not included in your order total and are your responsibility.

9. Returns and Refunds

Returns and refunds are governed by our Shipping & Return Policy, which forms part of these Terms.

All sales are final, with one exception: items that arrive damaged, misprinted, or defective. Where such an item is reported to us within 30 days of delivery with supporting photographs, and the claim is reviewed and approved, we will provide a replacement or a refund.

We do not offer refunds, returns, or exchanges for change of mind, for incorrect size or color selection, for incorrect or incomplete shipping addresses, for unclaimed or refused packages, or for delivery delays.

Where a package is lost or damaged in transit, we will submit a claim to our fulfillment partner and the relevant carrier on your behalf. Any resulting replacement or refund depends on the outcome of that claim. We do not control carrier claim decisions and make no guarantee as to their outcome or timing.

10. Intellectual Property

All designs, artwork, graphics, logos, text, and other content appearing on our products and this website are the property of BOSA or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Purchasing a product grants you ownership of the physical item only. It does not transfer any rights in the underlying design. You may not reproduce, copy, resell commercially, or create derivative works from our designs without our prior written permission.

11. Third-Party Services

Our Service relies on third-party providers, including our ecommerce platform, our print-on-demand fulfillment partner, payment processors, and shipping carriers. We are not responsible for the acts or omissions of these third parties, and your use of their services may be governed by their own terms and policies.

Our site may contain links to third-party websites that are not affiliated with us. We are not responsible for the content, accuracy, or practices of any third-party site, and we do not warrant any third-party materials or products. Any complaints or questions regarding third-party products should be directed to the third party.

12. Prohibited Uses

In addition to other prohibitions set out in these Terms, you are prohibited from using the site or its content: for any unlawful purpose; to solicit others to perform or participate in any unlawful acts; to violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances; to infringe upon or violate our intellectual property rights or those of others; to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate; to submit false or misleading information; to upload or transmit viruses or any other type of malicious code; to collect or track the personal information of others; to spam, phish, pharm, pretext, spider, crawl, or scrape; for any obscene or immoral purpose; or to interfere with or circumvent the security features of the Service. We reserve the right to terminate your use of the Service for violating any of these prohibited uses.

13. Disclaimer of Warranties

We do not guarantee, represent, or warrant that your use of our Service will be uninterrupted, timely, secure, or error-free. You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.

To the fullest extent permitted by law, the Service and all products delivered to you through the Service are provided "as is" and "as available" for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot lawfully be excluded or limited under applicable consumer protection law.

14. Limitation of Liability

To the maximum extent permitted by applicable law, in no case shall BOSA, our directors, officers, employees, affiliates, agents, contractors, suppliers, or service providers be liable for any indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, or replacement costs, arising from your use of the Service or any products procured using the Service.

Where liability cannot be excluded, our total liability to you for any claim arising out of or relating to these Terms or your use of the Service shall not exceed the amount you paid for the product giving rise to the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless BOSA and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

16. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

17. Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

18. Entire Agreement

These Terms and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior agreements, communications, and proposals. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

19. Governing Law

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois for the resolution of any disputes.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates to our website.
